These Terms of Service ("Terms") are an agreement between you and the SynDiary team ("SynDiary", "we") covering your use of the SynDiary app and this website. By installing or using the app you agree to these Terms. If you do not agree, do not use the app.
SynDiary is a local-first personal diary and data-hub app. It works without an account, stores your data on your device encrypted at rest by default, and processes AI features on your device unless you explicitly connect your own cloud AI key. How data is handled is described in the Privacy Policy, which forms part of these Terms.
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the app on devices you own or control, for your personal, non-commercial use. The app, its design, and its code remain the property of SynDiary and its licensors. Third-party components (including downloadable AI models) are licensed under their own terms, shown in the app where applicable.
Everything you write, record, import, or attach in SynDiary is yours. We claim no rights to it. It is stored on your device; we never receive it, and these Terms grant us no license to it. You are responsible for making sure content you import or store does not violate anyone else's rights.
Because your data exists only on your device, you are responsible for backups. The app provides export tools; use them regularly. If you use encrypted storage, your recovery code is the only way back into your data — we cannot reset or recover it for you, ever. Losing your device, uninstalling the app, or losing your recovery code without a current export can mean permanent loss of your data. To the maximum extent permitted by law, we are not liable for lost data.
Optional cloud AI features use your own API key with a third-party provider (such as Google, OpenAI, Anthropic, or Deepgram). Your relationship with that provider — including its terms, privacy practices, availability, and any usage costs it bills you — is between you and the provider. Keep your keys secure; you are responsible for activity under them. We may change the set of supported providers over time.
AI-generated content (chat replies, summaries, transcriptions) can be wrong, incomplete, or misleading. It is provided for personal reflection and convenience only and is not medical, psychological, legal, financial, or other professional advice. Do not rely on it for decisions that matter without independent verification. If you are in crisis, contact a qualified professional or emergency services.
Use the app only as permitted by law. Do not use it to infringe others' rights, to attempt to breach the security of third-party services, or to violate the terms of AI providers or platforms whose data you import. Do not reverse-engineer the app except where the law expressly permits it.
SynDiary is currently pre-release (beta) software. Features may change, break, or be removed, and updates may be required for continued use. Section 5 (backups) matters double during a beta.
The app and website are provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, non-infringement, or uninterrupted, error-free operation. Nothing in these Terms limits warranties or rights that consumer law grants you and that cannot be excluded.
To the maximum extent permitted by law, SynDiary is not liable for indirect, incidental, special, or consequential damages, or for loss of data, arising from your use of (or inability to use) the app — including data loss described in section 5 and third-party AI provider conduct described in section 6. Nothing in these Terms excludes liability that cannot be excluded by law, including liability for intent or gross negligence.
We may update these Terms from time to time. Changes are posted on this page with an updated date; material changes will also be flagged in the app or its release notes. Continuing to use the app after a change means you accept the updated Terms.
These Terms are governed by the laws of the Netherlands. Mandatory consumer-protection rules of your country of residence remain unaffected. Disputes are subject to the competent courts of the Netherlands, unless mandatory law provides otherwise.
